Summary

This is a classic double-edged sword. Yes, it does secure rights and remedies not otherwise available to independent workers, but it also opens the door to a massive influx of opportunistic trial lawyers and litigation. Each of these acts provide for damages and statutory attorney fees for any violation. It therefore, significantly alters the legal relationship IWs have with the companies with whom they do business. This bill could be very costly and therefore, ultimately reduce the economic incentive to contract with IWs. Yet another example of the law of unintended consequences. We do not believe there will be any further legislative activity on this bill.
